Permissibility and infringement. The judicialization of “sex change” during the civil-military dictatorship in Chile

El presente artículo analiza las formas de excepcionalidad política que surgieron al interior de regulaciones fragmentarias y “permisivas” que dieron lugar a la judicialización del “cambio de sexo” y que tuvieron como efecto la vulneración de las personas trans por parte de las instituciones del Estado chileno tanto durante el período dictatorial como posdictatorial. Se trata de desgranar las formas de violencia que se gestaron y fueron ejecutadas por instituciones del Estado chileno de la década de 1980, cuando el país se encontraba bajo una dictadura que convivió con la introducción de un modo de gobierno neoliberal. El presente texto se propone pensar de qué manera las historicidades trans perturban la clara distinción entre dictadura y posdictadura, obligándonos a confrontar distintos modos de aproximarnos al pasado que perturban la narrativa lineal de la historia reciente.

This article analyzes the politics of exceptionalism that emerged within fragmentary and “permissive” regulations that enabled the judicialization of “sex change” and that resulted in the infringement of trans people’s lives by the institutions of the Chilean State, both during the dictatorship and the post-dictatorial period. The article aims to identify different forms of violence that were developed and carried out by State institutions in the 1980s, when Chile was under a dictatorial regime that coexisted with the consolidation of a neoliberal governmentality. The present text proposes to consider how trans historicities disturb the clear distinction between dictatorship and post dictatorship, compelling us to confront different ways of approaching the past, disturbing linear historical narratives.
