O depósito legal na Argentina: análise da Ley 11.723/1933

This article presents a theoretical review on the subject of legal deposit of publications in Argentina, including a review of the law that regulates the legal deposit. Law 11,723 of 1933 September 28. “Regimen legal de la propiedad intellectual”, in the light of the recommendations proposed by Larivière in its publication entitled “Guidelines for legal deposit legislation”, published in 2000. The analysis of Argentine law demonstrates the need to adapt various issues raised by Larivière (2000). Broadly speaking, the law appears to be obsolete, requiring redesign to suit the purposes of legal deposit, hence, the objectives of the Universal Bibliographic Control.

O presente trabalho apresenta uma revisão teórica sobre o tema do depósito legal de publicações na Argentina, incluindo uma análise da lei que regula o depósito legal – Ley 11.723, de 28 de setiembre de 1933 - Regimen legal de la propiedad intelectual, à luz das recomendações propostas por Larivière, em sua publicação intitulada Guidelines for legal deposit legislation, publicada em 2000. A análise da lei argentina demonstra necessidade de adequações sob diversos aspectos apontados por Larivière (2000). De forma ampla, a lei mostra-se obsoleta, necessitando passar por reformulação a fim de se adequar aos propósitos do depósito legal e, consequentemente, aos objetivos do Controle Bibliográfico Universal.
